Terms of Service

These terms form an agreement between you and Jake Green, who operates Fathomly (“Fathomly”, “we”, “us”) from the United Kingdom. They cover the Fathomly iOS app, the Fathomly website and the Fathomly Scholar subscription. By creating an account or using the app you accept them. If you do not accept them, do not use Fathomly.

1. Who can use Fathomly

You must be at least 13 years old, or older where the law applicable to you requires a higher minimum age. Fathomly does not offer parent-managed or child accounts, so if you are below the minimum age that applies to you, you may not use Fathomly. If you are under 18, you must have permission from a parent or guardian. You are responsible for keeping your login details secure and for everything done through your account.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Fathomly for your own learning. You may not resell, sublicense, rent or commercially exploit the app or its generated content, reverse engineer or decompile it, use it to build a competing product, scrape it, or access it through automated means.

3. What Fathomly does

Fathomly turns a topic you choose, or a video link you paste, into a structured learning path of lessons, questions and spaced reviews, generated by AI. Paths, questions and marking are produced by AI models and may contain errors, omissions or outdated information. Fathomly is an educational aid only. It is not professional advice, and must not be relied on for medical, legal, financial, safety or other professional decisions.

4. Your content and third-party video links

You keep ownership of what you write. You grant us a licence to store and process it solely to operate the service for you. You must not submit unlawful, abusive, hateful, sexually explicit or infringing content, or content designed to manipulate the AI into producing harmful output.

When you paste a video URL we retrieve the publicly available transcript of that video, ourselves or through a third-party transcript service, in order to build a learning path about the subject matter. The transcript is used once and then discarded; we keep only an AI-generated summary of the subject matter. Fathomly does not host, copy, redistribute or make available the video itself. Videos and transcripts remain the property of their respective owners, and Fathomly is not affiliated with, endorsed by or sponsored by YouTube, Google or any content creator. You must only submit links to content you are lawfully entitled to access. If you own content and object to its use, email j25fts@gmail.com and we will remove it.

5. Free use and Fathomly Scholar

Fathomly can be used free with limits. A free account may generate up to 3 video-based paths and up to 15 lessons in each monthly allowance period. That period is not the calendar month: it runs from the day you created your account (or the day your free trial started) and resets on the same day each month. The app always tells you when your allowance next resets. Free-usage limits are applied per account and per device.

Fathomly Scholar is an auto-renewing subscription that removes the lesson limit, raises video-based paths to 15 per month, and unlocks AI Debate, The Defense, Your Curve and Deep Dive paths. For Scholar, the monthly allowance period runs from your subscription start date. It is offered monthly and yearly. The exact price for your country and plan is always shown on the subscription screen before you buy, and is charged in your local currency.

6. Refunds and cancellation rights

All purchases are processed by Apple, and Apple is the merchant of record. Refunds are handled solely by Apple under its terms, via reportaproblem.apple.com. We cannot issue refunds directly.

UK and EU consumers normally have a 14-day right to cancel a distance contract. Fathomly Scholar gives you immediate access to digital content, and the subscription screen states, before you confirm your purchase, that by subscribing you request that access begins immediately and acknowledge that you lose the 14-day cancellation right once access has been provided. Completing the purchase is that request and acknowledgement. This does not affect your statutory rights if the service is faulty or not as described.

7. Price changes and changes to the service

We may change subscription prices for future renewal periods. Apple will notify you and, where required, ask you to consent before the new price applies; you may cancel instead. We may add, change or remove features to improve the service, and may suspend it temporarily for maintenance.

8. Acceptable use and suspension

You must not attempt to bypass usage limits, create accounts in bulk, interfere with the security of the service, or use it in breach of any law. We may suspend or terminate an account that breaches these terms or exposes us to legal risk. Where practicable we will warn you first.

9. Intellectual property

Fathomly, its name, logo, design, code, curriculum structure and prompts are owned by Jake Green and protected by intellectual property law. Nothing in these terms transfers ownership to you.

10. Availability and no warranty

Fathomly is provided “as is”. We do not warrant that it will be uninterrupted, error-free, or that AI-generated content will be accurate or complete. To the extent permitted by law we exclude all implied warranties.

11. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited, and nothing affects your statutory rights as a consumer under the Consumer Rights Act 2015. Subject to that, our total liability to you in any 12-month period is limited to the amount you paid us in that period, and we are not liable for indirect or consequential loss, loss of profit, or loss of data.

12. Deleting your account

You can delete your account and data at any time in Settings → Delete account. Deleting your account does not cancel an Apple subscription — cancel that separately in your Apple ID settings, or you will continue to be charged.

13. Apple terms

These terms are between you and Fathomly, not Apple. Apple is not responsible for the app or its content and has no obligation to provide support or maintenance. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with the Apple Media Services Terms and Conditions, including the standard EULA at apple.com/legal/internet-services/itunes/dev/stdeula.

14. Changes to these terms

We may update these terms. The date at the top shows when they last changed, and we will tell you in the app or by email before a material change takes effect. Continuing to use Fathomly after that means you accept the new terms.

15. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EEA, you keep the benefit of any mandatory consumer protections of your home country.

16. Accessibility

We aim to make Fathomly usable by everyone, and we work towards the WCAG 2.2 AA standard and the accessibility requirements of the European Accessibility Act. The app supports the iOS system text-size, bold-text, reduce-motion and VoiceOver settings. If any part of Fathomly is difficult for you to use, or you need information in another format, email j25fts@gmail.com and we will reply within 5 working days.

17. Complaints and contact

If something goes wrong, email j25fts@gmail.com and we will reply within 5 working days. If we cannot resolve it, you can seek help from your local consumer advice service. Nothing here removes your right to bring a claim in court. Our postal address is at the foot of this page.
